Terms and Conditions

These Terms and Conditions ("Terms") govern access to and use of Fisku, a retail operating system provided by TechnoArts ("Company," "we," "us," or "our"), including the Fisku web application, desktop application, and any related services (together, the "Service"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Service region
The Service is currently offered exclusively to businesses operating within Pakistan. Features such as FBR digital invoicing, tax handling, and pricing are built around Pakistani retail operations and may not be suitable or available for use outside Pakistan.
2. Eligibility and account registration
You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the accuracy of the information you provide when creating an account, and for maintaining the confidentiality of your login credentials. You are responsible for all activity that occurs under your account, including accounts of staff you invite to your workspace.
3. Subscription and billing
Certain features require a paid subscription. Free trials, where offered, convert to a paid subscription only if you choose to subscribe; we do not charge you automatically at the end of a trial unless you have provided billing details and agreed to continued billing. Subscription fees are billed in advance on a recurring basis and are non-refundable except where required by law. You may cancel at any time from the billing portal within the Service; cancellation takes effect at the end of the current billing period.
4. Acceptable use
You agree not to, and will not permit others to:
- use the Service for any unlawful purpose or in violation of any applicable law or regulation;
- reverse engineer, decompile, or attempt to extract the source code of the Service, except where such restriction is prohibited by law;
- resell, sublicense, or provide access to the Service to any third party without our written consent;
- attempt to access any account, workspace, or data you are not authorized to access;
- interfere with or disrupt the integrity or performance of the Service.
5. FBR digital invoicing
Where enabled, the Service allows registered invoices to be submitted to Pakistan's Federal Board of Revenue (FBR) digital invoicing system. You remain solely responsible for the accuracy of the tax information, HS codes, sale types, and rates you configure and submit, and for your business's compliance with applicable tax law. The Service is a tool to assist with invoicing and does not constitute tax or legal advice.
6. Your data
You retain ownership of the business data you enter into the Service (sales, inventory, customer, and financial records). You grant us a limited license to host, process, and display that data solely to provide and improve the Service. Our handling of personal data is described in our Privacy Policy.
7. Intellectual property
The Service, including its software, design, and branding, is and remains the exclusive property of the Company and its licensors. These Terms do not grant you any rights to our trademarks, service marks, or logos.
8. Termination
We may suspend or terminate your access to the Service if you breach these Terms or if required by law. You may stop using the Service and close your account at any time. Certain provisions of these Terms, including ownership, disclaimers, and limitation of liability, survive termination.
9. Disclaimer of warranty
The Service is provided "as is" and "as available," without warranty of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or entirely secure.
10. Limitation of liability
To the maximum extent permitted by applicable law, the Company will not be liable for any indirect, incidental, special, or consequential damages, or any loss of profits or revenue, arising out of or related to your use of the Service.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date on this page. Continued use of the Service after a change constitutes acceptance of the revised Terms.
12. Governing law
These Terms are governed by the laws of the Islamic Republic of Pakistan, and any dispute arising under them is subject to the exclusive jurisdiction of the courts of Lahore, Punjab, Pakistan.
